It is with great regret that we must announce that our request to adopt Dylan Korkem has been refused by both the prosecutor and the judge with the same reasons as the other 6 couples which is he was not shown to enough Kazakh families before he was given up for international adoption. Even if we were 99% sure of the refusal it still killed us to hear this from the judge. We cannot even begin to comprehend on how they can get away with such an illegal, cruel and inhuman act.
We will appeal as soon as we have our refusal in writing which should be as soon as tomorrow. We really have a strong case and believe and have confirmation we will win and bring Dylan home but we just don’t know how long it can take.
We want to Thank both our coordinators in Canada (Anna Cheiman) and in Taraz (Vera and Medet) for all their SUPPORT and for all their ENORMOUS EFFORTS in trying everything possible to make this a positive decision, but this situation is beyond their control and now it is up to us to make a difference. We can confirm that everything was done legally and by the book by both Anna Cheiman , Vera and Medet. They are as devastated and just as heartbroken as us on this situation and refusal. They have guided us, helped us in every possible way and we remain forever grateful for their professionalism and honesty towards us.
Taraz adoption has really turned around for the worse and is the only region in Kazakhstan with this problem and we all cannot understand what the reason is. Our file was accepted by both Canadian and Kazakhstan laws and we followed all the procedures as requested. We received the letter of invitation by the Regional Department of Education which confirmed our file was accepted and everything was fine. The municipal court has absolutely no interest in the well being of the children. They have made every effort to deny all international adoption . Every case since the beginning of 2010 involving international adoption decided by the Taraz Municipal Court has been a denial.
We will let everyone know about this illegal situation because there is no law that states the children have to be shown to a certain amount of Kazakhstan families before they can be given up for international adoption. The requirement is that the children must be registered at the orphanage for 6 months before they can be given up for international adoption. Korkem was born premature on January 28, 2009 and was given up for adoption at birth. He remained in the hospital until March 2009 and was then brought to the orphanage. We met him in December/2009 at 10 months old.
Everyone must know about this illegal situation as it is our only hope for the superior court to change our court decision. We have invested a lot of time, energy and money to give up without a fight.

ReplyDeleteAllo Fil et Mary, Nous sommes désapointé des évènements qui se passe à Taraz. Ici nous faisons tous notre possible pour aider la situation. La SAI à envoyé une lettre à l'embassade du Kazakhstan à Ottawa qui l'enverra à son tour au responsable de l'adoption internationnal du Kazakhstan à Astana. J'ai recu un version de cette lettre que la SAI m'a envoyé et vos noms, les nôtres et ains que Nathalie et Christophe son mentionné. Du fait qu'il y ai plusieurs famille maintenant dans la même situation nous devrions tous gagner avec la force du nombre. Nous tenons à vous remercier de nous avoir donné des nouvelle d'Anna et Antoine ça nous a reconforté le coeur et ma mère à eu au moins une bonne nuit de sommeil en lisa ce petit message de votre part. Unfortunately the government officials can bend it to any sides they want - it's not in child's interest and interests of the prospective parents. They don't want the kids like Dylan to leave the country, at this age toddlers still have a lot of chances to be adopted by Kazakh families. For that reason international couples face all kinds of delays, refusals, bureaucratic nightmares! Dylan may be forced to stay longer in Kazakhstan to use all his chances to be adopted within the country.
Why don't you try to adopt an older kid 3-5 years old? They are cute at this age too. If there is a mental retardation or disorder you can see it right away. They talk, they walk. With toddlers you never know.
Nina, whoever you are!!! you don't understand the point, WE DON'T WANT ANOTHER CHILD, we have bonded and we want Dylan!!!! We are talking about a human being, not a car or something!!! The age of the child has absolutely nothing to do with the decision and for your information the problem here is for older children as well.

We wish you the same happy ending. By the way, to how many kazakh families your child was presented before you? We adopted from Uralsk and maybe the requirements are not the same but just for your information, we had documented data about three kazakh families (with names and reason for their refusal) in our court hearing (they said less than three is not enough). So maybe, just maybe, if for your appeal, you can find more documented data, i.e. names, let's say 5 or 6 families names, with the fact that they did not want the child because of let's say medical conditions, etc. you will have more chance to win. We are all sure your child has been shown to many many kazakh families durin his time in Baby house, but what if these data were not documented in a book or in a official document and presented to judge, maybe this can be done for next court hearing, like they always do in Uralks. Just a suggestion. Take care.
